Chapter 1. General Provisions

Article 1 (Purpose)

These Terms of Service are intended to define the conditions, rights, obligations, procedures, and responsibilities between the users (hereinafter referred to as the “User”) and OMTouch Co., Ltd. (hereinafter referred to as the “Company”) in relation to the services (hereinafter referred to as the “Service”) provided through the website operated by the Company (hereinafter referred to as the “Website”).

Article 2 (Definitions)
  1. “Website” refers to a virtual online platform operated by the Company (including https://www.om-touch.com/, mobile websites, and mobile applications) that enables Users to access, browse, purchase, and use goods or services through electronic communication devices such as computers or smartphones.
  2. “User” refers to any individual who accesses the Website and uses the services or goods provided by the Website in accordance with these Terms.
  3. “Password” means a confidential numeric code set by the User and registered with the Website for the purpose of verifying the User’s identity and protecting the security of the Service.
  4. “Authentication Method” refers to identity verification methods determined by the Website for security purposes, including but not limited to mobile phone verification, identity verification combined with mobile authentication, or email verification.
  5. “Authentication Information” refers to the information required for password setup and identity verification.
  6. “Biometric Information” refers to personal physical or behavioral characteristics used to identify an individual, including fingerprints, iris patterns, facial recognition, voice recognition, or vein patterns.
  7. “Business Day” means a day on which the Company normally provides services, excluding Saturdays, Sundays, and public holidays in the Republic of Korea.
  8. “Purchase Protection Service” means a service that temporarily holds a payment made by a purchaser for a certain period in order to protect the purchaser’s payment.
  9. “Secure Transaction Center” refers to an organization established to resolve issues related to transaction safety during the use of the Service.
  10. “Dispute Resolution Center” refers to a dispute mediation organization established by the Company to reasonably resolve disputes arising from transactions conducted through the Website.
  11. “Electronic Payment Processing Fee” refers to the fee paid to the payment gateway provider when a User purchases goods using payment methods such as credit cards or bank transfers.
  12. “Access Medium” refers to any means used to initiate electronic financial transactions or verify the authenticity of a User and transaction details, including passwords, electronic cards, and digital certificates.
Article 3 (Scope and Priority of Application)
  1. Chapter 1 (General Provisions) and Chapter 3 (Miscellaneous) apply to all services provided on the Website.
  2. If any conflict arises between the provisions of Chapter 1 or Chapter 3 and the provisions of Chapter 2 (Specific Services), the provisions of Chapter 2 shall prevail with respect to the relevant services.
  3. The Company may enter into separate agreements with specific sellers that differ from these Terms. In such cases, the individual agreement shall prevail over these Terms.
Article 4 (Service Description and Changes)
  1. The Website provides the following services to Users:
    • Providing information on goods or services and facilitating purchase agreements
    • Delivery or provision of goods or services purchased
    • Integrated user service
  2. The Website may change the details of goods or services to be provided under future contracts in cases such as product shortages or technical specification changes.
  3. If the Company changes the service content agreed upon with a User due to unavoidable circumstances, the Company will notify the User of the reason through a contact method available to the Company.
Article 5 (Posting and Amendment of Terms)
  1. The Website shall display these Terms, the Company name, representative name, address, contact information, business registration number, e-commerce registration number, and personal information protection officer on the main page of the Website so that Users can easily review them.
  2. The Website shall provide Users with clear explanations of important matters such as cancellation rights, delivery responsibilities, and refund conditions before Users agree to these Terms.
  3. The Company may amend these Terms to the extent that such amendments do not violate applicable laws including the Act on Consumer Protection in Electronic Commerce.
  4. If these Terms are revised, the Company will notify Users at least 7 days prior to the effective date. If the revision is unfavorable to Users, at least 30 days’ notice will be provided.
  5. The revised Terms shall become effective from the effective date.
Article 6 (User Information Management)
  1. Users must notify the Website of any changes to personal information such as address, email address, or phone number. The Company shall not be responsible for any damages resulting from inaccurate information.
Article 7 (Management of Access Media)
  1. If access media are lost or exposed, the User must immediately notify the Company.
  2. Users may not sell, lend, transfer, or pledge their access media to any third party.
  3. Users must take reasonable care to prevent theft, forgery, or alteration of access media.
Article 8 (Advertising)

The Website may display advertisements or send promotional information through SMS, email, or other communication methods in order to provide services. Users who opt out will not receive such communications.

Article 9 (Affiliated Merchants)
  1. Contract terms between Users and affiliated merchants are independent from the Company.
  2. Programs between the Company and affiliated merchants may be modified or terminated without prior notice.
  3. Users must comply with the policies of affiliated merchants when using their services.
Article 10 (Notice to Users)
  1. Notices to Users may be delivered via the mobile number registered by the User.
  2. Notices to multiple unspecified Users may be provided through postings on the Website for at least one week.

Chapter 2. E-Commerce Intermediary Services

Article 22 (Types of Services)
  1. The Company provides an online platform where transactions between Users may occur, including:
    1. Purchase support services
    2. Contract formation and payment protection services
    3. Customer support services
    4. Other e-commerce related services
    5. Advertising and promotional services

Chapter 3. Miscellaneous

Article 30 (Governing Law and Jurisdiction)
  1. Any dispute arising between the Website and Users shall be governed by the laws of the Republic of Korea.
  2. Legal actions shall be filed with the competent court in accordance with the Korean Civil Procedure Act.
Supplementary Provision

These Terms of Service shall become effective on May 10, 2025.

Article 1 (Purpose of Processing Personal Information)
  1. The Company processes personal information for the following purposes.
  2. Personal information will not be used for purposes other than those specified below. If the purpose of use changes, the Company will obtain separate consent in accordance with Article 18 of the Personal Information Protection Act.

Article 2 (Retention and Processing Period of Personal Information)
  1. The Company processes and retains personal information within the period required by applicable laws or the period agreed upon by the data subject.
  2. Retention periods are as follows:

  2. In emergency situations such as disasters, infectious diseases, or threats to life or property, personal information may be provided to relevant authorities without consent.
Article 4 (Outsourcing of Personal Information Processing)
  1. The Company entrusts certain personal information processing tasks to third parties for efficient service operation.

Article 5 (Destruction of Personal Information)
  1. Personal information will be destroyed without delay when the retention period expires or the processing purpose is achieved.
  2. If personal information must be retained under applicable laws, it will be stored separately in a different database or storage location.
  3. Methods of destruction:
    Electronic files are permanently deleted so that they cannot be restored.
    Paper documents are shredded using a secure shredder.
Article 6 (Rights of Data Subjects)
  1. Data subjects may request access, correction, deletion, or suspension of processing of their personal information at any time.
  2. Such requests may be submitted via written request, email, or fax, and the Company will respond without delay.
Article 7 (Security Measures)
  1. The Company implements appropriate technical and administrative security measures to protect personal information.
  2. These measures include employee training, access control systems, firewall protection, and secure storage of documents containing personal information.
Article 8 (Cookies)
  1. The Company uses cookies to provide customized services.
  2. Users may refuse cookies through browser settings, but some services may not function properly if cookies are disabled.
